Employment law is a vast field covering a wide range of legal issues concerning employees, employers and also the self-employed.

Representation

We represent our clients, both employees and employers, in the Labour Court, at Workplace Relations Commission in the matters of dismissal, discrimination in the workplace, employment contract issues, compliance with working time regulations and remuneration issues.

Our solicitors have represented employees before courts on numerous occasions in cases of discrimination against pregnant women, disciplinary dismissals, redundancies and breach of working time regulations. We have also represented entire groups of employees in cases of collective redundancies and breach of employees' rights following the transfer of undertakings by a new employer.

Employees

Employees usually face the following problems:

  • redundancies - determining entitlement to redundancy payment, correct calculation of employment history in the event of multiple changes of the company owner and breaks in employment, determining the weekly wage. We also provide legal advice on settlement agreements and voluntary redundancies
  • disciplinary dismissals - it is very important to get an appropriate legal advice at the stage of internal appeals and even at the stage of disciplinary procedures
  • discrimination - we have many times represented employees discriminated on the grounds of nationality and women discriminated during pregnancy
  • breach of working time regulations - in particular we advise on breaches of employees' rights to daily and weekly rest, overtime work, holiday entitlements

Employers

For the employers we offer the following services:

  • drafting of employment contracts considering the nature of the professional qualifications, registration issues and liability insurance for such employees (doctors, nurses, physiotherapists)
  • preparing disciplinary and complaint procedures as required under Irish employment law
  • advising on disciplinary procedures
